Return Policy 

I. Agreement
 This Return Policy is legally binding. Any usage of the Haute Melanin Couture (HMC or “we”) site requires accepting and agreeing to the Return Policy. Creating an account requires accepting and agreeing to the Return Policy. IF YOU DO NOT AGREE WITH ALL OF THIS RETURN POLICY, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SITE AND YOU MUST DISCONTINUE USE IMMEDIATELY. You further agree that you may use an electronic signature to enter into contracts or otherwise transact business on this Site. Where appropriate, simply clicking a link may be sufficient to constitute an electronic signature and confirm a purchase.

II. Return Policy For Damaged Items We pride ourselves with providing high quality, well crafted products. However, items are occasionally damaged during shipping and handling. If you provide notice within 3 days of receiving a damaged item, we will replace the item or provide store credit for a later purchase of equal value, at our sole discretion. To make a claim, please contact us immediate and provide your first and last name, tracking number, date of order, order number, item name, picture of the damaged item, and description of damage. You will be responsible for shipping back the damaged item. Shipping costs are non-refundable. We are not responsible for items that are not returned to us due to a failure in shipping. We recommend purchasing insurance for any valuable items which are shipped. In the unlikely event that we ship the wrong item to you, we will provide a return label under that circumstance only. Please allow 2 – 7 business days for us to ship your replacement item We do not accept returns for any reason other than damaged or defective goods or if the incorrect item is sent to you.

III. Items Sold As-Is Items that are sold on sale, clearance, last chance, or are otherwise marked as “as-is” are sold as-is. We are not responsible for damage caused by shipping or handling for such items. Such items may not be returned for any reasons and no refunds will issue.

IV. Shipping You are responsible for ensuring that your shipping address is correct. We will not be responsible or provide any compensation for items that are lost in shipping due to an error or typo in your address.

V. Use of Site by Minors HMC does not target minors of any age and does not solicit business from minors. HMC’s target market and target audience are adults over the age of majority. We reserve the right to automatically cancel and refund any orders that we find were placed by a minor aged of 13 or younger at our sole discretion. However, any orders placed by a minor aged 14 or older who has an account with parental permission is binding upon the minor and their parents and refunds will not be issued on the basis that the order was placed by a minor to the extent allowed by applicable laws.

VI. Governing Law and Jurisdiction This agreement is governed by the laws of the State of Nevada. You agree that all disputes under this agreement shall be resolved solely by the Courts sitting in Clark County Nevada.

VII. Disclaimer of Warranties The site and all goods and services of HMC are provided as-is with no warranties express or implied. All warranties are disclaimed to the extent permitted by law. In particular, but without limitation, HMC disclaims any warranties of merchantability or suitability for any particular purpose. HMC disclaims any liability for goods that are lost or damaged during shipping. To the extent permitted by applicable law, all shipments are FOB Shipping Point. The buyer accepts all risks involved in shipping. To the extent permitted by law, you agree that under no circumstances may HMC be liable to you for more than $1,000.00 for any violation by HMC of the Shipping and Returns Policy or any laws relating to the shipping or sell of goods.

VIII. Most Recent Update and Integration Clause This policy was most recently updated on November 17, 2022. HMC reserves the right to revise or change this policy at any time upon providing reasonable notice to its users. This agreement, when including the documents explicitly incorporated by reference, constitutes the entire agreement. You are not relying on any oral representations or on any statements made outside of this agreement or documents which are expressly incorporated by reference.
